Terms of Service

Last updated 16 October 2026

ClearServe is in a pilot with a small number of businesses. This page is written in plain language and may be refined as the service grows.

These terms explain how you may use ClearServe and what you can expect from us. By creating an account or using the service, you agree to them. If you do not agree, please do not use it.

1. Who we are

ClearServe is operated from South Africa. In this page, “we”, “us” and “our” mean ClearServe.

You can reach us through the request form on this website (clearserve.co.za/request-access).

2. The service

ClearServe is software for food businesses: taking and tracking orders, recording payments, running a kitchen screen, cash-up, stock and recipes, reports and staff accounts. You use it through a web browser.

The service is new and improving. We may add, change or remove features. During the pilot we give no guarantee that it will always be available or free of errors, and you should keep running your business in a way that does not depend entirely on it (for example, by keeping your own records alongside it until you trust the numbers).

3. Free trial and fees

A free trial lets you try the service at no charge for the period we tell you when we approve your application. We may extend a trial.

After a trial there is a simple monthly price for each location, which we will agree with you in writing before you are charged anything. We do not take a share of your sales. If you do not agree to a price, you can stop using the service and we will not charge you.

4. Your account

  • Give us accurate information when you apply and keep it up to date.
  • Keep your password private. We strongly recommend turning on two-step sign-in in My account.
  • You are responsible for the staff accounts you create, for choosing the right role for each person, and for what is done with those accounts. Remove people who no longer work for you.
  • Tell us straight away if you think someone has used your account without permission.

5. Your data

Your business data (your menu, prices, orders, payments records, stock, staff and reports) belongs to you. We store and process it only to provide the service to you, and we do not sell it or use it for advertising.

You can download your sales information at any time as CSV files from the dashboard. If you ask, we will give you a copy of the rest of your data in a common format.

Where your data contains personal information about your staff or customers (for example a customer’s first name written in an order note), you decide why and how it is used, and we process it on your behalf and under your instructions. Our Privacy Policy explains how we look after it. We may look at your data when it is needed to give you support, to keep the service secure, or if the law requires it.

6. How you may use it

Use ClearServe only for lawful purposes and for your own food business. Do not try to get into other businesses’ information, interfere with how the service works, overload it, copy it, or use it to send spam or anything unlawful. We may suspend access if the service is being misused.

7. Payments, tax and receipts

ClearServe records cash and card payments. It does not take card payments itself, and it is not a payment provider, bank or accountant. You remain responsible for your own card machine arrangements, your tax and VAT obligations, and for issuing receipts or tax invoices that meet the law.

8. Backups and availability

We take regular encrypted backups and test that they can be restored, but we cannot promise that nothing will ever be lost or that the service will never be interrupted. Please keep your own copies of anything important, such as the CSV downloads of your sales.

9. Suspending or ending your use

You may stop using ClearServe whenever you like. We may suspend or end your access if you break these terms, if an agreed fee is not paid after reasonable notice, or if we have to for security or legal reasons. We will give notice where we reasonably can.

When an account ends we will keep your data available for you to export for about 30 days, and then delete it, except for records we must keep by law. Copies in backups are removed as those backups age out.

10. Our responsibility to you

We will provide the service with reasonable care and skill. To the extent the law allows, we are not responsible for indirect losses, lost profit or lost sales, or for losses caused by things outside our control such as power or internet failures, your devices, or your card machine provider. To the extent the law allows, our total responsibility for any claim is limited to the fees you paid us in the three months before the claim arose.

Nothing in these terms takes away rights you have under South African law that cannot be limited, such as the Consumer Protection Act where it applies.

11. Changes to these terms

We may update these terms as the service grows. We will change the “last updated” date, and for important changes we will tell you in the service or by email. If you keep using ClearServe after a change, you accept the new terms.

12. Law and disputes

These terms are governed by the laws of South Africa. If we cannot settle a disagreement by talking, the South African courts have jurisdiction.

Questions about these terms: ClearServe through the request form on this website (clearserve.co.za/request-access).
